Marketing and Labeling Requirements for Fur

This notice is intended to serve as a reminder that all Merchandise you sell on Sears Marketplace, as well as all product listings, and content you supply related to the Merchandise, must comply with all applicable federal, state and local law, including the rules and regulations promulgated by any state or federal agencies.

The Federal Trade Commission has promulgated a number of labeling requirements for fur products, specifically under the Fur Products Labeling Act (FPLA), as amended by the Truth in Fur Labeling Act of 2010 (TFLA).  The Federal Trade Commission’s requirements are generally available on their website, www.ftc.gov.  The guidelines, the text of each act, and summaries of the requirements of the FPLA and FTLA are available here: http://business.ftc.gov/documents/alt006-fur-mation-alert-how-comply-fur-products-labeling-act.

Among other requirements, the FPLA mandates that all fur products, including advertisements for the fur products, include the geographical source of the fur, the name(s) animal(s) that produced the fur, whether the fur was bleached, dyed, or artificially colored, and whether it is composed in whole or in part of animal parts such as paws, tails, or waste fur.  Note that in addition to the FPLA and FTLA, the textile and garment labeling requirements of the Federal Trade Commission Act (FTCA) apply to Merchandise containing fur.

Violation of the FPLA can result in civil or criminal penalties, for which you, as the Marketplace seller, will be liable.  This notice is not intended to constitute legal advice.  We encourage you to consult with an attorney before listing any merchandise containing animal fur for sale on Sears Marketplace, to ensure compliance with all applicable laws and regulations.
